Terms of Service
WE DO NOT PROVIDE ACCESS TO EMERGENCY SERVICES: There are important differences between IntiCo, iTalkYou and SMS, mobile telephone, and landline services. Our Services do not provide access to emergency services or providers of emergency services, such as police, firefighters or hospitals, nor do they connect with public safety response points. You should make sure that you are able to contact your corresponding emergency services providers via a mobile or landline telephone or other service.
IF YOU ARE AN INTICO/ITALKYOU USER IN THE UNITED STATES OR CANADA, OUR TERMS CONTAIN AN OBLIGATORY ARBITRATION CLAUSE WHICH STIPULATES THAT, EXCEPT IN THE CASE OF VOLUNTARY EXCLUSION OR CERTAIN TYPES OF CONFLICTS, YOU AND Intico/iTalkYou AGREE TO RESOLVE ALL CONFLICTS VIA OBLIGATORY INDIVIDUAL ARBITRATION, WHICH MEANS THAT YOU WAIVE ANY RIGHT TO PRESENT SAID CONFLICTS IN FRONT OF A JUDGE OR JURY, AND THAT YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTION LAWSUITS, COLLECTIVE ARBITRATION, OR REPRESENTATIVE LAWSUITS. PLEASE READ THE SECTION ENTITLED “SPECIAL ARBITRATION CLAUSE FOR USERS IN THE UNITED STATES AND CANADA” BELOW FOR MORE INFORMATION.
About our services
Registration. You must register to use our Services with correct information, provide your current telephone number and/or email and, if you change it, update it via the function “cellular number” in the Profile section on the Website or in the corresponding section of the Profile menu in the mobile application. You agree to receive text messages and telephone calls (from us or external providers) with codes to register to use our services.
If you register to use Channelty services in the United States you will receive our services from iTalkYou COM LLC. If you register to use Channelty services outside of the United States you will receive our services from IntiCo USA Corp.
Address Book. You regularly provide us with the phone numbers of Intico/iTalkYou users and other contacts that you have in your mobile phone address book. You confirm that you are authorized to provide us with those numbers to allow us to provide our services.
Age. You must be at least 15 years of age to be able to use our Services (or the minimum age required in your country to receive authorization to use our Services without parental permission). In addition to being old enough to use our Services according to the applicable laws, if you are not old enough to accept our terms and conditions in your country, a parent or guardian must accept our Terms on your behalf.
Devices and software. You must provide certain devices, software, and data connections that we do not provide in order to use our Services. During the entire time that you use our Services, you agree to download and install updates to our Services, including automatically.
Taxes and fees. You are responsible for the costs of your mobile provider’s data plan (in the case that your telephone or device uses one), as well as for all other taxes and fees associated with the use of our Services. We may charge you for our services, including for all corresponding taxes. We reserve the right to refuse or cancel orders. We do not provide reimbursement for our Services, unless required by law.
Privacy and user data policy
Acceptable use of our services
Our Terms and Policies. You must use our Services in compliance with our published Terms and policies. If we deactivate your account due to a violation of our Terms, you will not create another account without our permission.
Legal and Acceptable Use. You must access and use our Services only for legal, authorized and acceptable purposes. You will not use (or help others to use) our services in ways that (a) violate, misappropriate, or infringe upon the rights of Intico/iTalkYou, our users or others, including privacy, publicity, intellectual property copyrights or other property rights; (b) are illegal, obscene, defamatory, threatening, intimidating, harassing, aggressive, ethnically or racially offensive or that promote or encourage illegal conduct or are in any other way inappropriate, including the promotion of violent acts; (c) involve the publication of falsehoods, erroneous declarations or deceitful affirmations; (d) that impersonate another individual; (e) that involve sending illegal or prohibited communications, such as mass messaging, automatic messaging, automated dialing, or similar methods; or (f) that imply any other non-personal use of our services unless we authorize otherwise.
Damage to IntiCo/iTalkYou or our users. You must not (nor help others to) access, use, copy, adapt, modify, prepare works that are derivative of our Services, nor distribute, license, sublicense, transfer, display, execute, or exploit in any other way our Services in unauthorized or prohibited ways, or in ways that affect, damage, or compromise us, our Services, our systems, our users or other persons. You must also not, directly or via automated means: (a) apply reverse engineering, alter, modify, create derivative works, decompile or extract code from our Services; (b) send, store, or transmit a virus or other damaging computer code through or on our Services; (c) obtain or attempt to obtain unauthorized access to our Services or systems; (d) interrupt or interfere with the integrity or performance of our Services; (e) create accounts for our Services through automated or unauthorized means; (f) compile information about our users in any prohibited or unauthorized way; (g) sell, resell, rent, or charge for our Services; or (h) distribute or make available our Services in a network where they could be used on multiple devices at the same time.
Keep your account secure. You are responsible for keeping your device and your IntiCo/iTalkYou account secure, and you should notify us immediately of any unauthorized use or security failure in your account or our Services.
Our Services can allow you to access, use, or interact with websites, applications, content, and other third-party products and services. For example, you can choose to use data backup services from third parties (such as iCloud or Google Drive) that are integrated with our Services or that interact with a button to share content on a third-party website that allows you to send information to your Intico/iTalkYou contacts. Keep in mind that when you use third-party services, their terms and privacy policies will govern the use of said services.
Your rights. IntiCo/iTalkYou does not claim rights to the information that you send for your IntiCo/iTalkYou account or via our Services. You must have the necessary rights to said information that you send for your IntiCo/iTalkYou account or via our Services, as well as the right to transfer or cede the rights and licenses in our Terms.
IntiCo/iTalkYou Rights. We are owners of all copyright, commercial brands, domains, logos, commercial images, commercial secrets, patents and other intellectual property rights associated with our Services. You may not use our copyright, commercial brands, domains, logos, commercial images, patents and other intellectual property rights.
IntiCo/iTalkYou’s license to you. We grant you a limited, revocable, nonexclusive license, that may not be sublicensed nor transferred, to use our Services, subject to and according to our Terms. This license is granted for the sole purpose of allowing you to use our Services, in the manner stipulated in our Terms. You will not be granted licenses or rights implicitly nor in any other form, except for the licenses and rights expressly granted to you. The scope of this license may vary according to the purchase of plans and/or extra services, which are described in the details of said plans and/or services
Reports of violations by third parties of copyright, commercial brands, and other intellectual property rights
To report complaints of violations by third parties of copyright, commercial brands, or other intellectual property rights, visit our [[Intellectual Property Policy]]. We may cancel your Intico/iTalkYou account if you repeatedly infringe upon the intellectual property rights of other people.
YOU DECIDE TO USE OUR SERVICES AT YOUR OWN RISK AND SUBJECT TO THE FOLLOWING DISCLAIMERS. WE PROVIDE OUR SERVICES “AS-IS” AND WITHOUT ANY KIND OF EXPLICIT OR IMPLICIT GUARANTEE WHICH INCLUDES, AMONG OTHERS, GUARANTEES OF MARKETABILITY, SUITABILITY FOR A PARTICULAR PURPOSE, TITLE, NON-INFRACTION AND ABSENCE OF ANY COMPUTER VIRUS OR OTHER TYPE OF HARMFUL CODE. WE DO NOT GUARANTEE THAT ANY INFORMATION PROVIDED BY US BE PRECISE, COMPLETE OR USEFUL, THAT OUR SERVICES BE OPERATIVE, BE FREE FROM ERRORS, PROTECTED OR SECURE, OR THAT OUR SERVICES FUNCTION WITHOUT INTERRUPTIONS, DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL AND WE ARE NOT RESPONSIBLE FOR CONTROLLING HOW AND WHEN OUR USERS USE OUR SERVICES OR THE FUNCTIONS, SERVICES AND INTERFACES THAT OUR SERVICES PROVIDE. WE ARE NOT RESPONSIBLE NOR ARE WE OBLIGATED TO CONTROL THE ACTIONS NOR THE INFORMATION (INCLUDING THE CONTENT) OF OUR USERS OR OTHER THIRD PARTIES. YOU RELEASE US, OUR SUBSIDIARIES, AFFILIATES, AND OUR AND THEIR DIRECTORS, MANAGERS, EMPLOYEES, PARTNERS, AND AGENTS (JOINTLY, THE “PARTS OF IntiCo”) FROM ANY COMPLAINT, LAWSUIT, CONTROVERSY, OR CONFLICT (JOINTLY, “COMPLAINT”) AND DAMAGES, KNOWN OR UNKNOWN, RELATED, DERIVED FROM OR CONNECTED IN SOME WAY WITH ANY COMPLAINT THAT YOU HAVE AGAINST ANY THIRD PARTY. YOU WAIVE ANY RIGHT YOU MAY HAVE UNDER ARTICLE 1542 OF THE CALIFORNIA CIVIL CODE OR ANY OTHER APPLICABLE SIMILAR REGULATION OR LAW FROM ANY OTHER JURISDICTION, WHICH INDICATES THAT: A GENERAL WAIVER DOES NOT INCLUDE DEMANDS THAT THE CREDITOR DOES NOT KNOW OR DOES NOT SUSPECT EXIST IN ITS FAVOR AT THE MOMENT OF THE EXECUTION OF THE WAIVER, WHICH, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER AGREEMENT WITH THE DEBTOR.
Limitation of responsibility
THE PARTS OF Intico/iTalkYou SHALL NOT BE RESPONSIBLE FOR ANY LOSS OF EARNINGS NOR ANY OTHER RESULTING, SPECIAL, PUNITIVE, INDIRECT OR INCIDENTAL DAMAGES RELATED, DERIVED FROM OR CONNECTED IN ANY WAY WITH THESE TERMS, US OR OUR SERVICES, INCLUDING IN THE EVENT THAT THE PARTS OF Intico/iTalkYou HAVE BEEN ADVISED OF THE POSSIBILITY OF SAID DAMAGES. OUR JOINT RESPONSIBILITY RELATED, DERIVED FROM OR CONNECTED IN ANY WAY TO OUR TERMS, US OR OUR SERVICES SHALL NOT EXCEED THE VALUE OF ONE HUNDRED DOLLARS (100 USD) OR THE QUANTITY THAT YOU HAVE PAID US IN THE LAST TWELVE MONTHS, WHICHEVER IS GREATER. THE AFOREMENTIONED DISCLAIMER OF RESPONSIBILITY FOR CERTAIN DAMAGES AND THE LIMITATION OF RESPONSIBILITY SHALL BE APPLIED TO THE MAXIMUM EXTENT ALLOWED BY LAW. IT IS POSSIBLE THAT THE LAWS OF SOME STATES OR JURISDICTIONS DO NOT PERMIT THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES AND, THEREFORE, IT IS POSSIBLE THAT SOME OR ALL OF THE EXCLUSIONS AND LIMITATIONS DESCRIBED ABOVE DO NOT APPLY IN YOUR CASE. WITHOUT PREJUDICE TO ANY DISPOSITION THAT ESTABLISHES THE CONTRARY IN OUR TERMS, IN SUCH CASES, THE RESPONSIBILITY OF THE PARTS OF Intico/iTalkYouSHALL BE LIMITED TO THE MAXIMUM SCOPE ALLOWED BY THE CORRESPONDING APPLICABLE LAW.
You agree to defend, indemnify, and release from all responsibility the Parts of Intico/iTalkYoufrom all obligation, harm, loss and expense of any kind (including reasonable lawyers’ costs and fees) related, derived from, or connected in any way to any of the following points: (a) your access to our Services or your use of them, including the information provided in relation to these; (b) your failure to comply or supposed failure to comply with our Terms; or (c) any erroneous declaration on your part. You will cooperate to the extent we require, to defend or resolve any Complaint.
Forum and jurisdiction. If you are an Intico/iTalkYou user located in the United States or Canada, the section entitled “Special arbitration clause for users in the United States or Canada” applies in your case. Please also read the said section in its entirety. If you are not subject to the section “Special arbitration clause for users in the United States or Canada”, you accept that you will resolve any Complaint that you have with us related, derived from or connected in any way to our Terms, us, or our Services (denominated, individually, as “Conflict” and, jointly, “Conflicts”) exclusively in the United States District Court for the Broward County of Florida, and you agree to submit to the personal jurisdiction of said courts for the purpose of litigating said Conflicts.
Applicable legislation. The laws of the state of Florida govern our Terms, as well as for any Conflict, be it in a court or arbitration, that could arise between you and IntiCo, independent from the clauses regarding legal conflicts.
Availability and termination of our services
Availability of our Services. Our Services may be interrupted for maintenance, repairs, or updates, which will occur after a prudent period of time following notification of our users. In the event of equipment or network failures, attempts will be made to notify our users of the situation, indicating an estimated resolution time in the event of service interruption, keeping in mind that it is an unforeseen, abnormal event. We may discontinue some or all of our Services, including some functions and compatibility with certain devices and platforms, which may occur with previous notification of our users and/or technical and/or commercial justification. Our Services may be affected by events out of our control, such as natural disasters and other events of force majeure.
Termination. We may modify, suspend, or terminate your access to our Services or your use of them at any moment and for any reason, for example, if you violate the letter or spirit of our Terms or cause harm or risk, or you carry out any action that leaves us, our users, or other persons legally exposed. The following clauses shall remain after the termination of your relationship with IntiCo: “Licenses”, “Disclaimers”, “Limitation of responsibility”, “Indemnification”, “Conflict Resolution”, “Availability and Termination of our Services”, “Others” and “Special arbitration clause for users in the United States or Canada”.
Unless a mutual agreement between you and us stipulates otherwise, our Terms constitute the entire agreement between you and us in relation to IntiCo/iTalkYou and our Services, and they substitute any other previous agreement.
We can ask you to accept additional terms for our Services in the future, which will prevail in case there is a conflict between our Terms and said additional terms.
Our Services are not intended for distribution or use in any country where said distribution or use would infringe on local legislation nor subject us to the regulations of another country. We reserve the right to limit our Services in any country.
You will comply with all laws regarding commercial sanctions and export controls applicable in and out of the United States (“Export Laws”). You will not export, reexport, provide or transfer in any other way, directly or indirectly, our services: (a) to any individual, entity or country prohibited by the Export Laws; (b) anyone on restricted lists of the government of the United States or any other country; or (c) for any purpose prohibited by the Export Laws, including nuclear, chemical or biological weapons, or missile technology applications without the required governmental authorizations. You will not use or download our Services if you are in a restricted country, if you currently appear on any restricted list of the government of the United States or any other country, or for any purpose prohibited by the Export Laws, and neither will you hide your location via an IP proxy connection or other methods.
Our Terms are written in United States English. Any translated version is provided exclusively for your convenience. In case there are discrepancies between the original English version and a translated version of our Terms, the original version in English is the binding document.
Any modification or withdrawal of our Terms requires our express consent.
We may modify or update these Terms. We will notify you of the modifications to our Terms, as appropriate, and we will update the “Last modification” date at the top of our Terms. By continuing to use our Services, you confirm that you accept our Terms, with any subsequent modification. If you do not agree with our Terms and with their modifications, you must cease using our Services. Please review our Terms periodically.
All of our rights and obligations in our Terms are assigned freely to any of our affiliates, in relation to any merger, acquisition, restructuring or sale of shares, or by order of law or any other means, and we can transfer your information to any of our affiliates, successor entities or new owners.
You will not transfer any of your rights or obligations with respect to our Terms to any third party without our previous written consent.
Nothing contained within our Terms will prevent us from complying with the law.
With the exception of that which is expressed herein, our Terms do not grant beneficiary status to any third party.
If we do not demand compliance with one or more of our Terms, this shall not be considered to be a renunciation of them.
If any of the clauses of these Terms is deemed to be illegal, invalid, or for any other reason inapplicable, said clause will be excluded from our Terms and shall not affect the validity and the applicability of the rest of the clauses, except that which is stipulated in the “Divisibility” section, in the “Special arbitration clause for users in the United States or Canada”
We reserve all rights that we have not expressly granted to you. In certain jurisdiction you may have rights as a consumer and our Terms do not have the intention of limiting said legal rights as a consumer that may not be voided by contract.
We always value your comments and suggestions about Intico/iTalkYou and our Services, but you should understand that we can use them without the obligation to compensate you for them (in the same way that you are not obligated to provide them)
Special arbitration clause for users in the United States and Canada
PLEASE READ THIS SECTION CAREFULLY BECAUSE IT CONTAINS ADDITIONAL CLAUSES THAT APPLY ONLY TO OUR USERS IN THE UNITED STATES AND CANADA. IF YOU ARE AN IntiCo/iTalkYou USER LOCATED IN THE UNITED STATES OR IN CANADA, THIS SECTION REQUIRES YOU TO AGREE TO OBLIGATORY INDIVIDUAL ARBITRATION FOR ALL CONFLICTS, EXCEPT THOSE THAT INVOLVE INTELLECTUAL PROPERTY CONFLICTS AND EXCEPT THOSE THAT CAN BE TRIED IN A SMALL CLAIMS COURT. THIS MEANS THAT YOU WAIVE YOUR RIGHT TO RESOLVE SAID CONFLICTS IN A COURT BEFORE A JUDGE OR JURY. THIS SECTION ALSO LIMITS THE TIME THAT YOU HAVE TO INITIATE ARBITRATION OR, IF PERMITTED, LEGAL ACTION. LASTLY, THIS SECTION CONSTITUTES A WAIVER OF YOUR RIGHT FOR THE CONFLICT TO BE TREATED AND RESOLVED AS A CLASS ACTION LAWSUIT, COLLECTIVE ARBITRATION, OR REPRESENTATIVE SUIT.
“Exempt Conflict” means any Conflict related to the application or infraction of your or our intellectual property rights (such as copyright, commercial brands, domains, logos, commercial images, commercial secrets and patents). For greater clarity and without prejudice to the aforementioned, said Conflicts related, derived from, or connected in any way with your privacy and publicity rights are not Exempt Conflicts.
Federal arbitration law. United States federal arbitration law governs the interpretation and application of the “Special arbitration clause for users in the United States and Canada”, including all matters regarding whether a Conflict between you and Intico/iTalkYou is a matter of arbitration.
Arbitration agreement for Intico/iTalkYou users located in the United States and Canada. For the Intico/iTalkYou users located in the United States or Canada, you as well as IntiCo/iTalkYou agree to waive your rights to a trial before a judge or jury for all Conflicts, save for Exempt Conflicts. You and Intico/iTalkYou agree that all Conflicts (save for Exempt Conflicts), including those related to, derived from, or connected in any way with your privacy and publicity rights, shall be resolved via a final and obligatory arbitration. You and Intico/iTalkYou agree not to combine a Conflict that is subject to arbitration under our Terms with a Conflict that is not eligible for arbitration according to our Terms.
The arbitration will be administered by the American Arbitration Association under its rules of commercial arbitration currently at the time that arbitration begins, including optional norms for emergency protection measures and supplementary procedures for consumer-related conflicts (jointly, “AAA Norms”). The arbitration will be presided over by a single arbiter selected in accordance with the AAA Norms. The AAA Norms, information related to the initiation of a Conflict and a description of the arbitration process can be consulted at www.adr.org. The arbiter will decide if a Conflict is eligible for arbitration. The location of the arbitration and the assignment of fees and costs for said arbitration will be determined in accordance with the AAA Norms. Without prejudice to the AAA Norms, we will reimburse you for all AAA administrative costs in Conflicts that are subject to supplementary procedures for consumer-related conflicts, unless the arbiter determines that a Conflict has been brought for the purposes of harassment or is completely unfounded.
Exclusion procedure. You can refuse this arbitration agreement. In that case, neither you nor we can demand that the other participate in an arbitration procedure. To refuse this arbitration agreement, you must notify us in writing with a letter postmarked within 30 days of: (i) the date that you accepted our Terms for the first time; or (ii) the date on which you agreed to this arbitration clause, whichever is later.

You must include: (1) your name and residential address; (2) the mobile telephone number associated with your account; and (3) a clear statement indicating that you reject the arbitration agreement of our Terms.
Small claims court. As an alternative to arbitration, if the rules of your local “small claims court” allow, you may present your Conflict before your local “small claims court”, as long as the matter is pursued individually (not collectively).
Deadline to initiate arbitration. You as well as we agree that for any Conflict (save for Exempt Conflicts) we must begin an arbitration procedure within one year from the date in which said Conflict was produced for the first time; otherwise, the Conflict shall expire. This means that if you or we do not initiate arbitration in the timespan of one year after the appearance of the Conflict, the arbitration will be rejected for having started too late.
Class-action suits, collective arbitration, or representative suits are not accepted for users located in the United States or Canada. Both you and we agree that if you are an Intico/iTalkYou user located in the United States or Canada, you and we may present Conflicts against one another only in our own name and not in the name of any other person or entity, nor any class of person. You and we agree not to participate in a class-action lawsuit, collective arbitration or Conflicts administered by private general counsel or in a representative capacity or consolidated Conflicts related with another person or entity in relation to any Conflict.
Divisibility. If the prohibition against class-action lawsuits and other Conflicts presented in the name of third parties turns out to be inapplicable to a Conflict, all of the aforementioned clauses under the section “Special arbitration clause for users in the United States and Canada” will be null and void with respect to said Conflict.
Forum for authorized legal actions. If you choose to reject the arbitration agreement, if your Conflict is an Exempt Conflict or if the arbitration agreement turns out to be inapplicable, you agree to the clauses of “Forum and jurisdiction” found in the “Conflict Resolution” section above.
Respect for your privacy is part of who we are. At IntiCo, we strive to develop our services on a foundation of solid privacy principles.

Information that We Collect
Intico/iTalkYou receives or gathers information about our users when we operate and provide our services, including during installation, access and use of our Services.
Information that you provide
Your account information. You provide your mobile telephone number and/or your email address to create an Intico/iTalkYou account. You provide us with the numbers in your mobile phone’s address book regularly, including the users of our services and the rest of the contacts in your mobile phone’s address book. You confirm that you are authorized to provide us with said numbers. You can also add other information to your account, such as a profile name, profile photo and status message.
Your messages. We keep your messages during the normal duration of our services. Once your messages have been delivered (including your chats, photos, videos, voice messages, documents and location information), they are not eliminated from our servers. Your messages are also stored on your own device. If a message cannot be delivered immediately (for example, if you are disconnected), it is stored on our servers and is sent to the recipient once the connection is re-established. To improve performance and deliver multimedia messages more efficiently, such as when many people share a popular video or photo, we may keep said content on our servers for a prolonged period of time.
Your connections. To help you organize the way in which you communicate with everyone else, you can create groups, allow yourself to be added to groups and distribution lists. Said groups and lists are associated with your account information.
Customer service. You may provide us with information related to your use of our Services, including copies of your messages and about how we can get in touch with you so that we can offer you our customer service. For example, you can send us an email with information related to the performance of an application or other problems.
Automatically gathered information
Registration use and information. We gather information related to performance, diagnostics and service. This includes information about your activity (such as the way in which you use our Services, the way in which you interact with others through our Services, and similar data), registry files, as well as performance, website, failure and diagnostic reports and registries.
Transaction information. If you pay for our Services, we may receive information and confirmation, such as payment receipts, including from the third party or application stores that process your payments.
Information about your connection and devices. We gather specific information about your device when you install, access, or use our Services. This includes information such as the hardware model, operating system, navigator, IP address and mobile network information, including the telephone number and device identifiers. We gather information about the location of your device if you use our location functions, as well as when you choose to share your location with your contacts, see nearby places or those that others have shared with you and likewise for diagnostic and troubleshooting purposes, for example, if you have problems with our application’s location sharing function.
Information about status messages. We gather information about your status and on-line message changes on our Services, such as if you are online (your “connection status”), the last time that you used our Services (your “last connection status”) and the last time that you updated your status message.
Information that others provide about you. We receive information that other people provide to us, which may include information about you. For example, when other users that you know use our Services, they may provide your telephone number from their mobile phone contact list (in the same way that you may provide theirs), or they may send you a message, send messages to the groups to which you belong, or call you.
External providers. We work with external providers that help us to operate, provide, improve, understand, personalize and market our Services, as well as offer assisstance for our Services. For example, we work with businesses to distribute our applications, offer our infrastructure, delivery, and other systems, provide map and place information, process payments, help us understand how people use our Services, and market our Services. These external providers may provide us with information about you in certain circumstances; for example, application stores may send us reports that help us diagnose and solve service problems.
Third-party services. We allow you to use our Services in relation with third-party services. If you use our Services with said third-party services, we may receive information about you from them. For example, if you use the “Share” button in Intico/iTalkYou in a news service to share an article with your Intico/iTalkYou contacts, groups or distribution lists, or if you decide to access our Services via the promotion of a mobile phone operator or a mobile device provider. Keep in mind that when you use third-party services, their own terms and privacy policies will govern the use of said services.
How we use the information
We use all the information that we have to help us operate, provide, improve, understand, personalize and market our Services, as well as offer assistance for our services.
Our Services. We operate and provide our Services, which includes offering customer service, as well as improving, solving and personalizing our Services. We understand how people use our Services and we analyze and use the information that we have to evaluate and improve our Services, investigate, develop, and test new services and functions, as well as carry out activities to troubleshoot issues with our Services. We also use your information to respond to you when you contact us. We use [[cookies]] to operate, provide, improve, understand, and personalize our Services.
Security. We verify accounts and activities, and we promote security inside and out of our Services, by investigating suspicious activity or violations of our Terms, as well as to make sure that our Services are being used legally.
Zero third-party banner advertisements. We do not permit third-party banner advertisements on IntiCo. It is not our intention to include them, but if at some point we do, we will update this policy.
Commercial messaging. We will allow you and third parties, as well as different businesses, to communicate using IntiCo, to exchange messages, such as order information, transactions, and appointments, delivery and shipping notifications, product and service updates, and marketing. For example, you may receive information about the status of an upcoming flight, or the receipt for something that you bought or a notification about the date of a delivery. The marketing messages you might receive may include an offer for something that might interest you. We do not want you to feel that you are receiving unwanted messages, which is why, as with all of your messages, you can manage these communications, and we will respect the options that you select.
Information that you and we share
You share information while you use our Services and you communicate through them, and we share your information to help us operate, improve, understand, personalize, give support and market our Services.
Your account information. Your telephone number, email address, name and profile photo, connection status and status message, last connection status and read receipts may be available for anyone that uses our Services, although you can configure your settings in our Services to determine what information you want to be made available to other users.
Your contacts and others. The users with whom you communicate may store and reshare your information (including your telephone number or messages) with others inside and out of our Services. You can use the settings and the block function in our Services to administer the users of our Services with whom you communicate and what information you share.
External providers. We work with external providers that help us to operate, provide, improve, understand, personalize, and market our Services, as well as offer assistance for our Services. When we share information with external providers, we require them to use your information according to our instructions and terms or with your express permission.
Third-party services. When you use third-party services that are integrated with our Services, these third parties may receive information about what you share with them. For example, if you use a data backup service integrated with our Services (such as iCloud or Google Drive), they will receive information about what you share with them. If you interact with a third-party service connected through our Services, it is possible that you are providing information directly to said third party. Keep in mind that when you use third-party services, their own terms and privacy policies will govern the use of said services.
Assignation, change of control and transfer
Management of your information
If you want to manage, change, limit, or eliminate your information, we allow you to do so with the following tools:
Service Settings. You can change the settings of our Services to manage certain information made available to other users. You can manage your contacts, groups and distribution lists, or use our block function to manage the users with whom you communicate.
Change your cellular telephone number, the name and photo of your profile, and your status message. You must change your cellular telephone number via our “Cellular Number” function on the website or in the application. You can change your profile name, photo and status message at any time.
Elimination of your Intico/iTalkYou account. You may eliminate your Intico/iTalkYou account at any time (including if you want to rescind your consent for us to use your information) via the “Eliminate my account” function in the application or from the website. When you eliminate your Intico/iTalkYou account, your undelivered messages will be eliminated from our servers, as well as the rest of your information that we do not need to operate and provide our Services. Keep in mind that if you only eliminate our Services from your device without using the “Eliminate my account” function in the application, we may store your information during a longer period of time. Remember that when you eliminate your account, it does not affect the information that other users have related to you, for example, their copy of messages you sent them.
Legislation and protection
We may gather, use, keep, and share your information if we believe, in good faith, that it is reasonably necessary to: (a) respond according to laws or norms, to legal processes or applicable government requests; (b) demand compliance with our Terms or any other term and policy applicable, including for investigations of possible infractions; (c) detect, investigate, prevent and address fraud and other illegal activities or technical or security problems; or (d) protect the rights, property and safety of our users, IntiCo, the Intico family of businesses or others.

What you should include in your copyright and trademark infringement notice
Please include the following information when you report a copyright or trademark violation to IntiCo:
Your contact information (complete name, mailing address, and telephone number). Consider that we normally offer your contact information, including your name and email address (if you provided one), the name of the organization or client who owns the rights in question, and the content of your report to the person whose content you are reporting. You may provide a professional or business email at which you prefer to be reached.
A description of the copyrighted work or trademark about which you are reporting an infringement of your rights.
A description of the content hosted on our services, which you assure infringes upon your copyright or trademark.
Enough information to allow us to locate the content within our services. The simplest way of doing so is providing the phone number of the person who has displayed the content in violation of our services.
A statement that:
In good faith, you believe that the use of the copyrighted or trademarked content previously described, in the way you have reported it, is not authorized by the copyright or trademark of its owner, agent, or the law.
The information in your report is correct; and
You declare, under oath, that you are the owner or agent authorized to act on behalf of the owner of the exclusive copyright or trademark that has allegedly been violated.
Your physical or electronic signature.
1.1 Text Messaging, IVR and Calling phones and premium rate numbers with Intico/iTalkYou Credit:
(i) Calling or Texting landlines and mobiles: The charges payable for calling phones (outside of a subscription) consist of a connection fee (charged once, per call) and a per-minute rate as set out on https://www.IntiCo.com/business.asp. All calls will be disconnected and require a re-dial after a 2-hour duration and an additional connection fee will be charged on re-dial.
(ii) Premium rate numbers: The charges payable for calling premium rate numbers consist of a per-minute rate available at https://www.IntiCo.com/business.asp. No connection fee is payable.
(iii) Intico/iTalkYou may change the rates for mailing, texting or calling phones and premium rate numbers at any time without notice to you by posting such change at https://www.IntiCo.com/tarifas_telefonica.asp. The new rate will apply to your next use after the new rates have been published. Please check the latest rates before you make your call. If you do not accept the new rates, do not make your call.
(iv) The duration of a call shall be based on one-minute increments. Fractions of minutes will be rounded up to the next minute. The connection fee, where applicable, will be charged at the beginning of the call. Any fractional currency unit charges will be rounded up to the nearest whole minimum currency unit, for example a total call price of $0.00036 will be rounded up to $0.0004. Charges incurred will be deducted automatically from the Intico/iTalkYou Credit balance in your User Account.
1.2 Charges for other Paid For Products: The charges for other Paid For Products will be confirmed to you before you complete a purchase from IntiCo. Intico/iTalkYou may change the charges payable for the purchase of such Products at any time without any notice to you. You can choose whether or not to accept the new charges prior to completing your next purchase of the applicable Product. The new charges will apply to your next purchase after the new charges have been published. Fractional currency unit charges for SMS usage will be rounded up to the nearest whole minimum currency unit. For example a total call price of $0.00036 will be rounded up to $0.0004.
1.3 Promotional Offers: From time to time, Intico/iTalkYou may offer Paid-For Products for free for a trial period. Intico/iTalkYou reserves the right to charge you for such Products (at the normal rate) in the event that Intico/iTalkYou determines (in its reasonable discretion) that you are abusing the terms of the offer, including if you are using any service, proxy or other devices or anonymous IP address that prevents us from locating you.
1.4 Tax: All prices for Paid For Products are inclusive of applicable taxes, including VAT, unless otherwise stated. You explicitly waive any right to VAT reimbursement from Intico/iTalkYou if the amount of VAT ultimately payable by the latter to the tax authorities would for any reason be lower than the amount of VAT collected from you. The territories in the EU set out below are outside the scope of EU VAT under Council Directive 2006/112/EC on the common system of VAT, as amended. The Intico/iTalkYou Website does not enable users in such territories to take advantage of this VAT exemption and we therefore do not provide the Products in such territories: Mount Athos, Canary Islands, French Overseas Departments, Aland Islands, Channel Islands, Heligoland Island, Büsingen / Buesingen Territory, Ceuta, Melilla, Livigno, Campione d’Italia and Italian Waters of Lake Lugano.
1.5 Third-Party Charges: Using the Software on mobile applications will use some of the data allowance available on the data package to which you have subscribed with your mobile network operator. Out-of-country usage may lead to significantly higher costs than regular usage, and you are solely responsible for keeping yourself informed and paying for possible roaming and other applicable charges levied by your mobile network operator.
2.1 Intico/iTalkYou Credit. You can pay for select Paid-For Products using Intico/iTalkYou Credit. You can purchase Intico/iTalkYou Credit using any payment method made available to you by Intico/iTalkYou from time to time. The Intico/iTalkYou Credit that you purchase will be credited to your User Account at the time of purchase (or if you are using a Intico/iTalkYou Credit voucher, at the time you redeem that voucher).
2.2 Other payment methods. Intico/iTalkYou does not guarantee that you will be able to use your Intico/iTalkYou Credit balance to purchase all Products. Where Intico/iTalkYou Credit cannot be used to pay for a Product, Intico/iTalkYou will make another payment method available to you. Intico/iTalkYou reserves the right to remove or amend the available payment methods at its sole discretion.
2.3 Recurring Payments. Where you purchase Products on a subscription basis (monthly, every 3 months or annually (as applicable)), you acknowledge and agree that this is a recurring payment and payments shall be made to Intico/iTalkYou by the method you have chosen at the recurring intervals chosen by you, until the subscription for that Product is terminated by you or by IntiCo.
(a) You can enable the Auto Recharge feature when you buy Intico/iTalkYou Credit by ticking the appropriate box. If enabled, your Intico/iTalkYou Credit balance will be recharged with the same amount and by the same payment method chosen when you first sign up for Auto-Recharge. For example, if you purchase 10 Dollars of Intico/iTalkYou Credit with your credit card, the recharge amount charged to your credit card will also be 10 Dollars of Intico/iTalkYou Credit. In future the same amount will be charged to your credit card every time your Intico/iTalkYou account balance goes below the threshold set by Intico/iTalkYou from time to time.
(b) If you purchased a subscription with a payment method other than credit card or PayPal, and you have enabled Auto-Recharge, your Intico/iTalkYou Credit balance will be recharged with the amount necessary to purchase your next recurring subscription.
(c) You can disable Auto-Recharge at any time by accessing and changing your settings in your User Account.
3. REFUND POLICY
3.1 When you purchase Paid-For-Products directly from Intico/iTalkYou you will be entitled to a cancellation period of fifteen (15) days (a “Cooling-Off Period”) unless you have made use of the Paid-For-Products in any way, in which case the Cooling-Off Period will be extinguished and your purchase cannot be cancelled or refunded.
3.2 Outside of the Cooling-Off Period, only subscriptions are refundable unless used or expired.
3.3 Expenditure of Intico/iTalkYou Credit, allocation of a Intico/iTalkYou Number, or use of any aspect of a subscription amounts to “use” of a Paid-For-Product. You hereby expressly agree that Intico/iTalkYou Numbers may be allocated before the end of the Cooling-Off Period and become non-refundable upon allocation.
3.4 The Cooling-Off Period and refunds do not apply to Paid-For-Products that are (i) purchased via a third party partner of Intico/iTalkYou (please contact the partner directly, who may decide in its sole discretion whether or not to pay a refund), (ii) not directly acquired online from Intico/iTalkYou (e.g. vouchers or pre-paid cards) (iii) paid for in cash using third party payment methods (such as a cash payment wallet or Intico/iTalkYou Reseller) and (iv) paid for and allocated to your Intico/iTalkYou Account by a Intico/iTalkYou Manager administrator or another Intico/iTalkYou user. They also do not apply to the Membership of Intico/iTalkYou Developer.
3.5 If, within the Cooling-Off Period, you wish to cancel and obtain a refund for a Paid-For-Product which (i) has not been “used” in accordance with Section 3.1 and (ii) does not fall within Section 3.2, 3.3 and 3.4, you can complete our Withdrawal Form found. For more information on how to complete the Withdrawal Form feel free to contact us.
3.6 If you believe that Intico/iTalkYou has charged you in error, you must contact Intico/iTalkYou Customer Services within 60 days of such charge. No refunds will be given for any charges more than 60 days old.
3.7 Intico/iTalkYou reserves the right to refuse a refund request if it reasonably believes (i) that you are trying to unfairly exploit this refund policy, for example, by making repetitive refund requests in respect of the same Product; (ii) if you are in breach of these Terms or (iii) if Intico/iTalkYou reasonably suspects that you are using our Products or Software fraudulently or that your User Account is being used by a third party fraudulently.
3.8 This refund policy does not affect your statutory rights.
